TERMS AND CONDITIONS

Welcome to notforthemnyc.com (the “Website”). The Website is operated by NOT FOR THEM (“NOT FOR THEM,” “we,” “us,” or “our”).
These Terms and Conditions govern your use of the Website, purchases from our online shop, and appointments or visits to the NOT FOR THEM space. By accessing the Website, placing an order, or booking a visit, you agree to these Terms.
1. ABOUT NOT FOR THEM
NOT FOR THEM is a New York cultural company working across art, fashion, objects, exhibitions, gatherings, and collaborations.

Visits are available by appointment Tuesday through Saturday, from 11 AM to 7 PM.
2. WEBSITE USE
You may use the Website only for lawful personal and commercial purposes consistent with these Terms.
You may not:

  • Use the Website for fraudulent, unlawful, or abusive activity.

  • Attempt to interfere with the Website’s operation or security.

  • Copy, reproduce, distribute, or commercially exploit Website content without written permission.

  • Use automated systems to collect information from the Website.

  • Misrepresent your identity or payment information.

  • Use our name, artwork, photographs, or designs in a manner that suggests an unauthorized association with NOT FOR THEM.

We may suspend or restrict access to the Website when we reasonably believe these Terms have been violated.
3. PRODUCTS AND AVAILABILITY
The Website may offer original artwork, limited editions, apparel, objects, publications, and other items.
Many products are produced in limited quantities or exist as unique works. Placing an item in your cart does not reserve it. Availability is not guaranteed until payment has been accepted and the order has been confirmed.
We may limit quantities, withdraw products, refuse orders, or cancel an order when an item is unavailable, incorrectly priced, suspected of fraud, or otherwise unable to be fulfilled. If we cancel an order after payment, we will refund the amount charged.
4. PRODUCT IMAGES AND DESCRIPTIONS
We make reasonable efforts to present products accurately. Colors, textures, dimensions, finishes, and other details may appear differently depending on lighting, photography, screens, or the handmade nature of an item.
Original artwork and handmade or limited objects may contain variations and irregularities. These are part of the character of the work and are not necessarily defects.
Measurements are approximate unless expressly stated otherwise.
5. PRICING AND PAYMENT
Prices are displayed in U.S. dollars unless otherwise stated. Applicable sales tax, shipping, delivery, insurance, customs duties, and other charges may be added at checkout.
Prices and availability may change without notice. A pricing or description error does not obligate us to complete a sale at the incorrect price.
By submitting payment information, you confirm that:

  • The information provided is accurate.

  • You are authorized to use the selected payment method.

  • You authorize us and our payment providers to charge the full order amount.

6. ORDER ACCEPTANCE
An order confirmation acknowledges that we received your order. It does not necessarily mean the order has been accepted.
A purchase is accepted when we confirm fulfillment or shipment. We reserve the right to request additional information before accepting an order.
7. SHIPPING AND DELIVERY
Shipping estimates are not guaranteed delivery dates. Delays may occur due to carriers, weather, customs, production schedules, or circumstances outside our reasonable control.
If no shipping timeframe is provided, we will ship within the period required by applicable law. If we cannot ship within the promised or legally required period, we will notify you and provide any cancellation or refund options required by law.
Customers are responsible for providing a complete and accurate shipping address. Additional charges resulting from an incorrect address, refused delivery, or unsuccessful delivery attempt may be the customer’s responsibility.
Risk of loss passes as permitted by applicable law. Please contact us promptly if a shipment is lost or arrives damaged.
International customers are responsible for applicable customs duties, taxes, brokerage fees, and import restrictions.
8. RETURNS AND EXCHANGES
Unless a product page states otherwise, eligible apparel and non-art objects may be returned within 14 days after delivery.
To qualify for a return, an item must be:

  • Unused, unworn, and unwashed.

  • In its original condition and packaging.

  • Accompanied by proof of purchase.

  • Returned only after receiving authorization from us.

Original artwork, commissions, personalized items, made-to-order products, limited editions, intimate apparel, gift cards, and items marked “final sale” cannot be returned unless damaged, defective, or otherwise required by law.
Customers are responsible for return shipping costs unless the item arrived damaged, defective, or incorrect. Original shipping charges are nonrefundable unless required by law.
Approved refunds will be issued to the original payment method. We may reduce or deny a refund when an item is returned used, damaged, incomplete, or outside the return period.

9. DAMAGED OR INCORRECT ORDERS
Please inspect your order upon delivery. Report damaged, defective, missing, or incorrect items to access@notforthemnyc.com within seven days of delivery.
Include your order number, a description of the issue, and clear photographs of the item and packaging. Keep all original packaging while the claim is reviewed.
We may offer a repair, replacement, exchange, or refund depending on the circumstances and availability.
10. ARTWORK AND CERTIFICATES
Where applicable, artwork may include a certificate of authenticity or related documentation. Ownership of a physical artwork does not transfer copyright, reproduction rights, merchandising rights, or any other intellectual-property rights unless expressly agreed in writing.
Purchasers may not reproduce, modify, manufacture from, tokenize, license, commercially display, or commercially distribute an artwork or its image without written permission from the applicable rights holder.
11. APPOINTMENTS AND VISITS
Appointments are subject to confirmation. Submitting an appointment request does not guarantee availability.
Visitors must comply with reasonable studio rules and instructions. We may refuse or end a visit when necessary to protect people, artwork, property, privacy, or the operation of the space.
Unless permission is granted, visitors may not:

  • Touch, move, or handle artwork or objects.

  • Enter private or restricted areas.

  • Conduct professional photography, filming, or recording.

  • Use images of the space or its contents for commercial purposes.

  • Disrupt an exhibition, appointment, event, or private gathering.

Personal belongings remain the visitor’s responsibility.
12. EVENTS AND PROGRAMMING
Exhibitions, dinners, gatherings, and other programs may be changed, postponed, or canceled. Admission requirements and event-specific terms may apply and will be communicated separately when relevant.
Attendance at an event does not grant permission to photograph, record, reproduce, publish, or commercially exploit artwork, performances, guests, or private activities.
13. INTELLECTUAL PROPERTY
The Website and its contents—including artwork, photographs, video, text, graphics, logos, product designs, layouts, and branding—are owned by or licensed to NOT FOR THEM and are protected by intellectual-property laws.
You may view the Website for personal, noncommercial purposes. No other license or right is granted.

14. THIRD-PARTY SERVICES AND LINKS
The Website may contain links to third-party websites or use services provided by payment processors, shipping carriers, social platforms, or other providers.
We do not control and are not responsible for third-party content, availability, security, policies, or practices. Your use of third-party services may be governed by separate terms.
15. PRIVACY
Our collection and use of personal information are described in our Privacy Policy. By using the Website, you acknowledge that information may be processed as described in that policy.
16. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Website and its content are provided on an “as is” and “as available” basis.
We do not guarantee that the Website will always be uninterrupted, error-free, secure, or free from harmful components. Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by law, NOT FOR THEM and its owners, employees, artists, collaborators, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the Website, a product, an appointment, or an event.
Our total liability relating to a purchased product will not exceed the amount paid for that product, except where applicable law does not permit such a limitation.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
18. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless NOT FOR THEM and its owners, employees, contractors, artists, and collaborators from claims, damages, costs, or expenses resulting from your unlawful use of the Website, violation of these Terms, or infringement of another party’s rights.
19. GOVERNING LAW
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Any dispute that cannot be resolved informally will be brought in a court of competent jurisdiction located in Kings County, New York, unless applicable law requires otherwise.
20. CHANGES TO THESE TERMS
We may revise these Terms periodically. Updated Terms will be posted on this page with a new effective date.
Changes apply prospectively from the date they are posted. Continued use of the Website after an update constitutes acceptance of the revised Terms.
21. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
22. ENTIRE AGREEMENT
These Terms, together with any applicable Privacy Policy, Return Policy, product-specific terms, and written purchase agreement, constitute the agreement between you and NOT FOR THEM concerning use of the Website.
For original artwork, commissions, collaborations, rentals, or other negotiated transactions, a separate written agreement may apply. If that agreement conflicts with these Terms, the separate agreement will control for that transaction.
